1. validity and definition of terms

CineRoom (MaRoJa Escape GmbH, Unterer Geisberg 6, 96129 Strullendorf) offers services in the field of Live Escape Games and Outdoor Adventures to interested persons (hereinafter: “Customer”). The following General Terms and Conditions conclusively and exclusively regulate the conclusion of the contract between CineRoom (provider) and the customer, as well as its execution.

2. subject of the contract

2.1 The subject of the contract is the implementation of the offered leisure events in the form of live escape games or outdoor adventures. CineRoom offers Escape Rooms for private individuals as well as individual team building events.

2.3 Customers over the age of 18 are entitled to book. The group of participants of the Escape Game can also consist of younger participants from the age of 10. For children and young people up to 18 years of age, participation is only possible when accompanied by a person of full age.

2.4 The Escape Game will start punctually at the time and location stated on the booking confirmation. It is requested to be on site 10 minutes prior to the start of the appointment to ensure sufficient time for proper briefing by the staff. In the event of late arrival after the start of the appointment, the agreed service cannot be provided and the event cannot be held. There is no right to reimbursement in case of delay.

3. conclusion of the contract

3.1 Registration for the game can be made via the website or by e-mail. Both booking types entail a binding contract conclusion.

3.2 Booking via the homepage

3.2.1 Escape games and outdoor adventures are offered for booking via the homepage of CineRoom (www.cine-room.de). The presentation and advertising of the various leisure activities do not constitute a binding offer to conclude a contract.

3.2.2 The customer can choose between the offered Escape Games, outdoor adventures and predetermined free dates within the opening hours. For the booking of the event, CineRoom requests data such as name, e-mail address, telephone number and, if applicable, billing address of the customer, which are necessary for the booking processing.

3.2.3 By selecting and confirming the payment option and clicking on the button “Order subject to payment”, the customer submits a binding application to conclude the contract. With the booking the customer accepts the terms and conditions. The customer can print and save the GTCs via his browser. After sending the order, CineRoom sends the customer a booking confirmation by e-mail. The contract is concluded with this booking confirmation. The booking confirmation is to be checked by the customer immediately; any errors are to be communicated to the provider immediately.

3.3 Booking by e-mail

3.3.1 Also when booking via e-mail, the customer chooses between the available rooms and implementation times within the framework of the opening hours. For booking, the customer must provide the necessary personal information, room and date requests via e-mail.

3.3.2 By sending the booking request, the customer accepts the GTCs, which he can access and save via the website. After the booking request, CineRoom will send the customer a booking confirmation by e-mail. The contract is concluded with this booking confirmation. The booking confirmation is to be checked by the customer immediately; any errors are to be communicated to the provider immediately.

3.4 In the event that the customer has ordered a voucher by mail, the voucher with voucher code will be communicated to him by e-mail. This entitles the customer or a third person to whom the voucher has been transferred to use the voucher amount as a means of payment for the agreed service when booking Escape Games online and on site.

3.5 In case of conclusion of the contract, the contract is concluded with: MaRoJa Escape GmbH, Unterer Geisberg 6, 96129 Strullendorf.

4. cancellation, no-show, change of booking and refunds

4.1 According to § 312g para. 2 No. 9 BGB, a revocation is excluded, since it is a leisure activity, which provides for a specific date for the performance. Depending on which ticket option was selected at the time of booking, it is possible to change the booking or exchange it for a voucher. 

4.2 The change of the number of participants of a booking is still possible free of charge on the day of the event, as far as the minimum number of players of 2 persons is not fallen short of and the maximum number of players per activity is not exceeded. In this case, the amount to be paid is that of the players actually attending the match. No money will be refunded if the number of participants is reduced.

5. remuneration and payment modalities

The remuneration payable is based on the size of the Group. Their amount is indicated on the website of the provider and can be seen in the ordering process. The amount is inclusive of VAT and is due for payment with the booking confirmation. The payment is possible directly after the booking online via Pay Pal or Stripe.

6. vouchers

6.1 Vouchers for the performance of an Escape Game can be purchased online and directly on site. The vouchers are basically service vouchers and not value vouchers and can only be redeemed for bookable leisure events at CineRoom . The value of the voucher is always inclusive of the current statutory value added tax.

6.2 Vouchers can only be used to pay for a service, a claim for cash payment of the vouchers against CineRoom is excluded. Vouchers issued by CineRoom lose their validity upon expiration of three years from the date of purchase of the voucher.

7. liability

7.1 Subject to the following exceptions, the liability of CineRoom for breaches of contractual obligations is limited to tortious acts based on intent or gross negligence. If CineRoom is in default of performance due to slight negligence, if the performance has become impossible or if a material contractual obligation is breached, the liability for material damage and financial loss resulting therefrom shall be limited to the foreseeable damage typical for the contract. An essential contractual obligation is an obligation the fulfillment of which makes the proper execution of the contract possible in the first place, the violation of which endangers the achievement of the purpose of the contract and the observance of which the customer may regularly rely on. This includes, in particular, the obligation to take action and to fulfill the contractually owed performance, which is described under point 2.

7.2 CineRoom is not liable for lost or stolen wardrobe and valuables. Lockers are available in the video-monitored checkroom area for the safekeeping of valuables during the Escape Game. The provider does not assume any duty of care in this respect. Likewise, no liability is assumed for items of clothing or objects that are damaged during the execution of the event.

7.3 The premises of CineRoom contain technical elements (e.g. 12V magnets, flickering/flashing lighting) and materials (woods, metals and textiles), which in individual cases may cause symptoms of illness or allergies. For this CineRoom assumes no liability. Any pre-existing health conditions are to be communicated to the game leader before the start of the Escape Game; participation takes place at the customer’s own responsibility.

8. notes on data protection and data processing

8.1 CineRoom processes personal data of the Users only in compliance with the applicable data protection regulations and in line with the principles of data minimization and data avoidance. This means that the user’s data is only processed with legal permission, in particular if the data is required for the provision of our contractual services and online services, or is required by law, or if consent has been given.

8.2 With regard to the personal and usage-specific data, the Customer has the rights to information, correction and deletion guaranteed by the Federal Data Protection Act; these rights are to be exercised by sending a message by post (contact details under section 1) or by e-mail to info@cine-room.de.

9. prohibited behavior of the customer

9.1 All contents of the events in the rooms as well as the rooms themselves are protected according to § 2 Copyright Act. Photography and recording of video and audio material on the premises of the Provider is prohibited. More on this under point 12.

9.2 It is not permitted to bring food and beverages into the event room.

9.3 Smoking is prohibited in all areas of the venue.

9.4 The carrying of potentially dangerous objects such as knives, firearms, tools, laser pointers and the like is prohibited.

9.5 CineRoom may deny a customer access to the venue if there is reason to fear that the person concerned will disrupt the course of the performance or the general business operations or disturb other visitors due to alcohol or drug consumption or for other reasons.

9.6 Animals must remain outside.

10. required behavior of the customer

10.1 For the duration of the stay at the venue, the customer undertakes to use the premises with care, in particular the furnishings and inventory of the game rooms. CineRoom reserves the right to civil prosecution in case of damage caused by negligent behavior or violation of the rules set by the staff or the GTCs, as well as criminal prosecution in case of intentional damage.

10.2 The Customer undertakes to follow the instructions of the employees of CineRoom and to refrain from disturbances of the operational procedure of any kind.

10.3 Mobile phones and other electronic means of communication as well as acoustic signaling devices of any kind are not permitted in the game rooms. In the interest of a trouble-free event, CineRoom is entitled to request the user of such devices to switch off the device immediately.

11. expulsion and ban from the house

11.1 In case of violation of the above provisions of points and 9 and 10 of the GTCs, CineRoom is entitled to expel the respective visitor from the premises.

11.2 Notwithstanding its other rights, the Provider shall be entitled to issue a temporary or permanent ban from the premises in individual cases in the event of significant or repeated disruption and violations of these provisions.

12. sound, photo and film recordings, trade secrets

12.1 Sound, photo and film recordings are prohibited in the entire premises of CineRoom for copyright reasons. In the event of violations of the ban on recording, a contractual penalty shall become due, without prejudice to further claims. Recording devices and cameras of any kind are not allowed in the Escape Rooms, but must be stored in the lockers in the checkroom area.

12.2 In case of non-compliance, the recording equipment can be confiscated and kept by the staff of CineRoom . They will be returned to the owner when the owner has agreed to the deletion of the recordings and the deletion has been made.

12.3 The puzzles and solutions of the adventures are trade secret of CineRoom and may not be disclosed to third parties. In case of violation, the provider will take legal action against the violator and claim all damages against him.

13. picture and camera recordings during the implementation of the recreational activities.

13.1 The Customer agrees to be observed by the Gamemasters via a screen during the performance of the recreational activities. This is for the safety of the customers. This is a live broadcast.

13.2 Furthermore, we point out that surveillance cameras are installed in all areas. Video surveillance is intended in particular to prevent theft and protect employees and customers.

14 Applicable law and place of jurisdiction

The law of the Federal Republic of Germany shall apply. The place of jurisdiction for all disputes arising from the contractual relationship between the Customer and the Provider shall be the registered office of the Provider, provided that the Customer is a merchant, a legal entity under public law or a special fund under public law.

15. severability clause

Should any provision of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
